I have been married for a year now and right now I am on conditional greencard... Yesterday I was going through my wife email who is U.S. citizen is cheating on me.. I printed out all those conversation and saved it.. I was wondering if that is enough for me to file removal of condition on my self if I divorce my wife before second interview.. No one can imagine how hard it is for me right now, because she is using me for my money and she hardly work.. Can someone please give some thought or ideas about how to get out for me

@manoj1, I am not a lawyer but AFAIK , you going through your wife's email without her consent is already illegal, so I don't think you can do anything on that grounds, you might run into more trouble.

If you are on conditional green card, I would wait till I get an unconditional one before you take any official action.

After you get your greencard you can file for divorce on grounds that your spouse was cheating on you. In my opinion, the email you saved can be used in your favor.

I think the judge will have to weigh in the severity of the situation here. What is a worse? Cheating or reading email? You did not hack into her account to read her email. It was left logged on and you read what was available in front of you.

In the meantime you will have to suck it up. Try to come up with some situation back home so you send a big bulk of your income to your family in Nepal so your soon to be ex wife does not finish up all of your hard work savings.

You won't lose your green card unless your marriage was fraudulent. If you're divorced prior to 2 year timeframe (conditional gc), you might be required to prove that the marriage was legit.

There is a thing called VAWA (violence against women's act) passed by congress for protection of women from domestic violence. Even it is passed for women law should not discriminate you based on gender(equal protection clause ;14 amendment US constitution).
You can get a green card or your condition removed.
Find a VAWA lawyer....

Your spouse writing an exotic conversation via emails is not enough to consider you are having a bad marriage, unless you can show some concrete evidence of  her sending/receiving NUDE  pictures via emails to other person(s}.
