TPS bata F1 ma convert kasaile gareko cha? I'm not asking about reinstatement. Yo pali H1 parena bhane university ma admission lera F1 ma convert garne ni option huna sakcha hai. Reinstate garna milne ko reinstate gare huncha. Yo kuro chai espcially IT ma kam gari raheka manche haru lai kam lagna sakcha. If you are inspected and admitted, then apply for University and file I-539 to convert the status to F1. This also has premium processing for ~2K dollars. You can get stamped for F1 when you go to Nepal, but you can study as F1 student without leaving the country.

This is impossible dost . Tps is dead end , the only way getting out of tps is extending tps to further infi ity or marry a US CITIZEN .

Pandit ji bhako manche ni tha cha malai if you can provide valid reason. If you have pretty good bank balance in the US, then there is no reason for USCIS to deny unless you have a criminal history. TPS ta dead nai ho, I agree with that. Tara aru status ma jana time dincha. Ki ta lawsuit le 1-2 barsa time paincha. Tyo time bhitra F1 ma convert garera master's garna gaye huncha.

Being out of status more than 180 days will be just a waste of time if you are looking forward to come back in F-1 status. Its a straight NO NO from them.

It is better to apply asylum rather than reinstating . And even 1 day of immigration voilation will lead to denial of adjustment of status later . Good luck

Naya degree lai naya F1 garna paincha reinstate bhanda pani yo chai change of non-immigrant status bhanya ho. Ek palta travel garera get admitted in TPS and you can change non immigrant status to F1. You need to get stamping if you leave the country though.

If you haven't accumulated unlawful presense then you should be able to get it. Yedi F1 bata TPS aaye pachi out of status bhako ho bhane unlawful presense hudaina.

@shreeRam great info thanks!. Can you tell me does it have to be a new degree? What if a continuation of a degree? And if no travel history?

No automatic transition:
TPS does not automatically grant eligibility for F-1 status; you must apply separately.
Change of status process:
To change to F-1, you will need to submit USCIS Form I-539, Application to Extend/Change Nonimmigrant Status.
School acceptance required:
You must be accepted by a SEVP-certified school and receive a new I-20 form to be eligible for F-1 status.

I think you can continue your degree. If you went out of status then get a new I20 and file for reinstatement. You just need to get a new I20 for applying for the change of status. Travel is required only for people who are not inspected and admitted.

@ ShreeRaam how much money is good for bank statement? I understand it depends on the tuition fees, but what's the appropriate way to calculate? I used to pay loans. Need to understand different options.

I would say at least the total cost of the tuition, but honestly I’m not sure. Maile IT wala tehi bhara bhaneko. 100k bank balance ta normally huncha IT wala ko. Teti le ta pugna parne ho. Maile bujhe anusar USCIS le documents pugya cha bhane dherai kichkich nagari approve garcha re. Kunai bela chai interview lai ni bolauna sakcha re. So present yourself as a genuine student who can afford to pay for the degree.

@ShreeRaam do you know how long does USCIS take to process in average? I guess getting bank statements from parents is another option.

Regular processing time is too long. According to my research, USCIS offer premium processing for around 2k and they guarantee to complete within 30 days.

@ShreeRaam After it gets approved from the university, we need to apply to the USCIS. Do you know if we are allowed to take classes in that waiting period? I am guessing F-1 status is not valid or active until USCIS completely processes the application with a decision?
