I am on OPT right now and  have been approved for H1B this year. My husband is here now on tourist visa and plans to be back to Nepal on september for sometime. My question is can he apply for H4 before its effective date or should he wait till the effective date to apply?  What is the procedure to go for it?

He can apply before effective date of your H1b once it is approved.

Please apply for the H-4 with effective dates as per your H approval dates. Your spouse will have to apply for a new H-4 visa to reenter US once it is approved. H-4 may only be filed while in the US.

You mean he has to file in US before leaving for Nepal? Can that be before October 1st? How long does it usually take to be approved?
