hey amricane....I have one question...I filed my tax in february and I didnt have any information about this american credit thing....can i still reapply for this credit...I heard you can do amendment to receive it...can you tell me more about it...is it risky to do that?? plz help

I am still waiting for itin# for my spouse, do i still get that if i file my tax after april 15? i know i am getting refund so i wouldn't be penalized.

TO Americane:: Hey i did try filing for a friend of mine who just came here last fall2009 but one of his friend who also came in with him who is also ofthe same age 20yrs old got the 1000 in retuyrn but my friend didn't!!..........are there any criterias that has to be met???

The $1000 that you're talking about is given in the form of american opportunity credit and ONLY US CITIZENS can claim it. I understand that you must have claimed the credit by filing your 1040 just like an american citizen; but you probably should not advertise it openly like this and influence others to file their returns inappropriately as this might lead to problems in the future.

I second Sajhababa, http://www.irs.gov/faqs/faq/0,... You cannot claim the Hope Credit/American Opportunity Credit if any of the following applies: Your filing status is married filing separately. You are listed as a dependent in the Exemptions section of another person's tax return (such as your parents'). Your modified adjusted gross income can not be above a certain dollar limitation. You (or your spouse) were a nonresident alien for any part of the tax year, and the nonresident alien did not elect to be treated as a resident alien for tax purposes. (For additional information, refer to Publication 519, U.S. Tax Guide for Aliens). You claim the Lifetime Learning Credit for the same student in the same year. However, if you are resident alien, you can get $1,000 refund if you have at least spent $1,000 towards qualifying education expenses and haven't worked during 2009/2010.
